Agreement

These Terms of Use (“Terms”) govern your use of Art of Birding websites, apps, and related services (the “Service”) operated by 508 Life LLC, Palm Beach Gardens, FL 33418. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

Art of Birding provides a subscription experience that pairs a WiFi microphone we ship with a cloud account. The Service identifies birds locally on your device, syncs species detections, generates scheduled artwork, and displays a private living frame on a subdomain you claim.

New members pay a one-time hardware setup fee for a provisioned WiFi microphone (subject to availability and shipping), then a monthly subscription (presently The Migrant or The Resident). Monthly billing typically begins after a short delay so the device can arrive and be configured. Pricing is shown on the site and may change with notice. Upgrading or downgrading a subscription does not re-charge the one-time setup fee.

Accounts

You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account. Notify us promptly of unauthorized use at hello@artofbirding.com.

Subscriptions & billing

Paid plans are billed on a recurring basis (e.g., monthly) via our payment processor (Stripe). Fees are generally non-refundable except where required by law or where we state otherwise. You may cancel according to the tools we provide; access continues through the paid period unless we say otherwise.

Acceptable use

• Do not misuse the Service, attempt to access others’ accounts or displays, or disrupt systems.
• Do not use the Service for unlawful surveillance or in violation of local law.
• Do not reverse engineer or abuse rate limits, APIs, or pairing mechanisms beyond normal personal use.

Artwork & intellectual property

The Art of Birding name, logos, and site design are owned by 508 Life LLC. Generated canvases are provided for your personal, non-commercial enjoyment unless we grant broader rights in writing. You may share stills from your own account as the product allows. Third-party technologies (including BirdNET and Google Gemini) remain subject to their own terms and licenses.

Privacy

Our Privacy Policy explains how we handle information. Audio does not leave your Pi; only species detections and account data are processed as described there.

Disclaimer

The Service is provided “as is.” Bird identification and generative artwork are probabilistic and may be inaccurate or unavailable. We do not warrant uninterrupted operation, specific species coverage, or particular artistic outcomes. To the fullest extent permitted by law, 508 Life LLC disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent permitted by law, 508 Life LLC and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our aggregate liability for claims relating to the Service will not exceed the amounts you paid us in the twelve months before the claim.

Indemnity

You agree to indemnify and hold harmless 508 Life LLC from claims arising out of your misuse of the Service or violation of these Terms.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Courts in Palm Beach County, Florida shall have exclusive jurisdiction, except where prohibited.
